1. INTRODUCTION

This Affiliate Agreement (“Agreement”) is provided by Expand Your Horizons Academy (“EYH Academy”). The primary website address is https://www.eyhacademy.com, with additional referring domains from affiliates directing traffic to our site.

This Agreement outlines your responsibilities as an Affiliate and our obligations to you. It is a legally binding contract, and by signing up, you acknowledge that you have read, understood, and agreed to the terms set forth below. If you do not agree to these terms, do not register as an affiliate.

2. DEFINITIONS

a) Company: Expand Your Horizons Academy, referred to as “EYH Academy,” “we,” “us,” or “our.”

b) Affiliate: The person or entity participating in our program, referred to as “you” or “your.”

c) Parties: EYH Academy and the Affiliate collectively.

d) Website: Refers to https://www.eyhacademy.com.

e) Foundation Members: Members who joined at the $129 AUD per month rate before the price increase.

3. AFFILIATE REGISTRATION & ACCEPTANCE

- To participate, you must register through Post Affiliate Pro, our affiliate management platform.

- You will receive a unique referral link to track commissions.

- EYH Academy reserves the right to accept or reject any application at our discretion.

- Accounts may be terminated if we determine that an affiliate has violated this Agreement, engaged in fraudulent activity, or otherwise acted against EYH Academy’s interests.

4. NON-EXCLUSIVITY

- This Agreement does not create an exclusive relationship between you and EYH Academy.

- You may promote other programs, and EYH Academy may work with other affiliates.

5. COMMISSION STRUCTURE & PAYOUT POLICY

Affiliate Earnings

- Affiliates earn $40 AUD per month per active referral, regardless of the membership price.

- Commissions are recurring as long as the referral remains an active paying member.

- Membership price changes do not affect affiliate commissions.

Payout Schedule & Active Status Requirement

- Commissions are paid on the 1st day of each month for earnings generated between the 1st and last day of the previous month.

- Affiliates MUST remain active through the 1st of the month to receive their commissions. If an affiliate cancels before the 1st, commissions are forfeited.

Membership Price Adjustment (Effective April 1, 2025)

- The standard membership fee will increase from $129/month to $159/month.

- Foundation Members who originally joined at $129/month and later cancel will have 30 days to reinstate their account at the original rate. After 30 days, they must rejoin at the new rate of $159/month.

6. FOUNDATION MEMBER PAY-IN-FULL OPTION

Prepaid 12-Month Membership

- EYH Academy offers an option where members can prepay for 11 months at $129 AUD/month and receive 1 additional month free (total of 12 months).

Renewal at Foundation Rate

- If a Foundation Member has completed their 12-month pay-in-full option, EYH Academy will happily renew their 12-month plan at the Foundation rate of $1,419/year including 1 month FREE.

Switching to Monthly Payments

- If a Foundation Member who prepaid for 12 months wishes to switch to monthly payments, we will honor the $129 AUD/month rate.

Lapse in Membership & Price Adjustment

- If a pay-in-full Foundation Member does not renew within 30 days of their 12-month term ending, they will be required to rejoin at the new price of $159/month.

7. REFUNDS, CHARGEBACKS & COMMISSION ADJUSTMENTS

- If a referred member requests a refund or initiates a chargeback, the affiliate will not receive a commission for that membership.

- EYH Academy reserves the right to reverse commissions from future payouts in cases of chargebacks or fraud.

8. AFFILIATE RESPONSIBILITIES & COMPLIANCE

Marketing & Promotional Guidelines

Affiliates agree to ethical and legal promotion of EYH Academy, which includes:

- No misleading claims about earnings, results, or guarantees.

- Mandatory disclosure that you earn a commission when promoting EYH Academy, as required by Australian Consumer Law (ACL), FTC (USA), and global marketing regulations.

- No spamming, deceptive advertising, or unsolicited promotions.

Prohibited Activities

Affiliates must NOT:

- Use cookie stuffing, hidden tracking scripts, or unauthorized redirects.

- Bid on EYH Academy brand keywords in Google Ads, Facebook Ads, or any PPC platform.

- Impersonate EYH Academy in marketing materials or social media accounts.

- Solicit EYH Academy members for outside businesses.

9. REPORTS & TRACKING

- Affiliates may access real-time reports via Post Affiliate Pro to track referrals, commissions, and earnings.

- EYH Academy reserves the right to audit affiliate activity and verify commission eligibility before processing payouts.

10. TERMINATION POLICY

- This Agreement remains in effect as long as the affiliate is active.

- EYH Academy may terminate any affiliate account at any time for violations of this Agreement.

- If an affiliate is terminated for a policy violation, outstanding commissions will be forfeited.

11. INTELLECTUAL PROPERTY & BRAND USAGE

- Affiliates are granted a limited, non-transferable, revocable license to use EYH Academy branding solely for affiliate promotions.

- Unauthorized modifications, misrepresentations, or misleading use of EYH Academy branding will result in termination and potential legal action.

12. MODIFICATION & NOTICE POLICY

- EYH Academy reserves the right to modify this Agreement at any time.

- Affiliates will be notified electronically of significant changes at least 7 days in advance.

- Continued participation in the program after modifications constitutes acceptance of the new terms.

13. GOVERNING LAW & DISPUTE RESOLUTION

- This Agreement is governed by the laws of Australia.

- Dispute Resolution: Any disputes will be resolved through mediation in Australia before legal action is taken.

14. LIABILITY LIMITATION & DISCLAIMERS

- EYH Academy is not responsible for affiliate earnings, business losses, or any indirect damages.

- The program is provided “as is,” without guarantees or warranties.

15. SPAM POLICY & SERVICE INTERRUPTIONS

- Spam violations (unsolicited bulk emails, misleading promotions) will result in immediate termination.

- EYH Academy reserves the right to suspend services for maintenance or security reasons without liability.

16. ENTIRE AGREEMENT

This Agreement represents the entire agreement between EYH Academy and affiliates, superseding all prior agreements.
